By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not access or use the Service.
1. Service Description
Zelle® is a digital payments network that allows you to send money to and receive money from other people. The Service is made available through the websites and mobile applications of participating financial institutions and through the Zelle® mobile application.
2. Eligibility
To use the Service, you must:
- Be at least 18 years old
- Be a resident of the United States
- Have a bank account with a participating financial institution
- Have a valid email address or U.S. mobile phone number
- Provide accurate and complete information when registering for the Service
3. Registration and Account Security
When you register for the Service, you agree to:
- Provide accurate, current, and complete information
- Maintain and promptly update your information
- Keep your password and access credentials confidential
- Notify us immediately of any unauthorized use of your account
- Accept responsibility for all activities that occur under your account
4. Using the Service
4.1 Sending Money
You may use the Service to send money to another person who has registered with Zelle® or is otherwise eligible to receive funds through the Service. You must provide the recipient's email address or U.S. mobile phone number. You authorize us to debit your designated account for the amount of the transfer plus any applicable fees.
4.2 Receiving Money
When someone sends you money through the Service, we will notify you at the email address or phone number you provided during registration. You authorize us to credit your designated account for the amount of the transfer.
4.3 Transaction Limits
We may impose limits on the amount and frequency of transfers you can make using the Service. These limits may vary based on your account history, transaction activity, and other factors. We will notify you of any applicable limits.
5. Fees
We do not charge a fee to use the Service. However, your financial institution may charge fees related to your use of the Service. You are responsible for any fees imposed by your financial institution, as well as any fees associated with your internet or mobile device usage.
6. Prohibited Activities
You agree not to use the Service to:
- Conduct transactions for illegal purposes
- Violate any laws, regulations, or third-party rights
- Send money to people you do not know or trust
- Create multiple accounts to evade transaction limits or other restrictions
- Provide false, inaccurate, or misleading information
- Transfer money for commercial purposes
- Engage in fraudulent or deceptive activities
7. Liability
7.1 Unauthorized Transfers
You are responsible for all transfers made from your account using the Service. If you believe your account has been accessed without your authorization, you must notify us immediately. Your liability for unauthorized transfers is governed by your agreements with your financial institution and applicable law.
7.2 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF THE SERVICE.
8. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
We do not guarantee that the Service will be uninterrupted, secure, or error-free. We are not responsible for the accuracy, reliability, timeliness, or completeness of information provided through the Service.
9. Indemnification
You agree to indemnify, defend, and hold harmless Zelle®, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
10. Termination
We may suspend or terminate your access to the Service at any time for any reason without notice. You may terminate your use of the Service by closing your account. Termination does not relieve you of any obligations incurred prior to termination.
11. Changes to Terms
We may modify these Terms at any time by posting the revised Terms on our website or within the Service. Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of the revised Terms.
12. Governing Law
These Terms are governed by the laws of the United States and the state of Delaware, without regard to its conflict of law principles. Any dispute arising from these Terms or the Service shall be resolved in the federal or state courts located in Delaware.
